Terms and Conditions of Sale
These Terms and Conditions ("Terms") govern every sale of goods and services by SoCal PC Fix, a sole proprietorship ("Seller," "we," "us"), whether the sale takes place in person, by appointment, through online marketplaces (including but not limited to eBay, Facebook Marketplace, OfferUp, or Craigslist), or through this website. By purchasing any item from Seller, the buyer ("Buyer," "you") agrees to be bound by these Terms in full. If you do not agree to these Terms, do not complete the purchase.

1-Scope of Products Sold
Seller sells three categories of computer hardware and related electronics, each defined as follows:
New — Unopened or factory-sealed items sold in original retail packaging, not previously owned or used by any third party.
Open box — Items with original packaging opened, previously displayed, returned, or lightly used, which may show signs of prior handling but are represented to be in working condition unless otherwise disclosed at time of sale.
Used — Pre-owned items, including refurbished, salvaged, or parts-tested equipment, which may show cosmetic wear, prior use, or modification, and are sold based on their condition at the time of sale.
The category applicable to each item will be disclosed to Buyer prior to purchase, either verbally, in a listing description, or on the sales receipt/invoice. It is Buyer's responsibility to ask questions about condition before completing purchase.
2-Sold "As Is" — No Warranties
Except as expressly stated in Section 3 of these Terms, all products are sold "as is" and "with all faults." Seller makes no representation or warranty of any kind, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, or non-infringement, regarding any product sold.
Buyer acknowledges and agrees that:
Used and open box items may have a shorter remaining useful life, reduced battery capacity, cosmetic imperfections, or components that have been previously repaired, replaced, or modified.
Seller does not guarantee compatibility of any item with Buyer's specific hardware, software, or intended use unless expressly confirmed in writing prior to sale.
Any specifications, benchmarks, or performance descriptions provided by Seller are estimates based on Seller's own testing and may vary under actual use conditions.
Buyer is strongly encouraged to inspect and/or test any item in person before completing purchase, where reasonably possible.
3-Return, Refund, and Exchange Policy
Because condition varies by category, return eligibility depends on the category disclosed to Buyer at the time of sale, as follows:
Used items: All sales final. No returns, refunds, or exchanges will be accepted on used items for any reason, except where required by applicable law.
Open box items: May be returned within seven (7) calendar days of the delivery or pickup date, provided the item is returned in the same condition it was delivered, showing no additional damage, missing components, or signs of misuse beyond what was disclosed at sale.
New items: May be returned within thirty (30) calendar days of the delivery or pickup date, provided the item is returned in the same condition it was delivered — unopened where applicable, with all original packaging, accessories, and documentation, and showing no damage not present at the time of delivery.
Any return request outside these windows, or involving an item that does not meet the "no damage as delivered" condition described above, will be refused at Seller's sole discretion. Buyer must contact Seller before returning any item to obtain approval and instructions; unauthorized returns may be refused or subject to a restocking fee. Refunds, when approved, will be issued using the original payment method where possible, less any shipping or payment processing fees already incurred by Seller.
4-Inspection Period and Notice of Defects
Buyer must inspect all items immediately upon receipt. Any claim that an item was not as described, defective, or damaged in a way covered by Section 3 must be reported to Seller in writing (text, email, or messaging platform used for the sale) within the applicable return window stated above. Claims made after the applicable window has expired will not be honored, regardless of the reason for delay.
5-Data and Software Disclaimer
Buyer is solely responsible for backing up any personal data before delivering a device to Seller for any purpose, and for backing up or transferring data before reselling or disposing of a device purchased from Seller. Seller is not responsible for any data loss, and does not guarantee that any software, operating system license, or account associated with a used or open box device will remain valid, licensed, or usable by Buyer. Any operating system, software, or license included with a sale is provided "as is" and Seller makes no guarantee of continued activation or support.
6-Limitation of Liability
To the maximum extent permitted by law, Seller's total liability for any claim arising from or related to a purchase — whether based in contract, tort, negligence, or otherwise — shall not exceed the amount actually paid by Buyer for the specific item giving rise to the claim. In no event shall Seller be liable for any indirect, incidental, consequential, special, or punitive damages, including but not limited to lost data, lost profits, or damage to other equipment or property, even if Seller has been advised of the possibility of such damages.
7-Repairs and Services
Where Seller performs diagnostic, repair, or upgrade services on a device owned by Buyer, Buyer authorizes Seller to open, test, and work on the device. Seller is not responsible for pre-existing conditions, unrelated failures that occur during or after service, or data loss, except where caused by Seller's gross negligence. Any parts installed by Seller during a repair are covered only by the specific warranty terms (if any) stated in writing on the invoice for that repair, separate from these general Terms.
8-Payment
Full payment is due at the time of sale unless otherwise agreed in writing. Seller reserves the right to refuse or cancel any sale prior to completion of payment. All prices are in U.S. Dollars unless stated otherwise.
9-Assumption of Risk
Buyer assumes all risk associated with the purchase and use of any item sold, including risks inherent to purchasing used or open box electronics. Buyer represents that they have the technical knowledge to use the purchased item safely or have sought appropriate guidance from Seller before use.
10-Dispute Resolution and Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles. Any dispute arising out of or relating to a purchase from Seller shall first be addressed through good-faith direct communication between the parties. If the dispute cannot be resolved informally within thirty (30) days, it may be brought only in the small claims or applicable court located in Los Angeles County, California, and Buyer and Seller each waive any right to a jury trial to the extent permitted by law.
11-Severability and Entire Agreement
If any provision of these Terms is found unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. These Terms, together with any written invoice or receipt provided at the time of sale, constitute the entire agreement between Buyer and Seller regarding the purchase, and supersede any prior verbal representations not expressly confirmed in writing.
12-Acknowledgment
By completing a purchase, submitting payment, or accepting delivery of an item from SoCal PC Fix, Buyer acknowledges that they have read, understood, and agree to be bound by these Terms and Conditions.
